What is the On-Hire Labour Agreement (OHLA)?

The On-Hire Labour Agreement (OHLA) allows an approved business to sponsor skilled overseas workers on a temporary basis and then on-hire them to other businesses. Unlike standard employer sponsorship, where the sponsoring company directly employs the worker, the on-hire sponsor remains the legal employer while the worker is on-hired to third parties.

What visa does the candidate need to be eligible for engage skilled overseas workers under the OHLA?

Candidates will need to be eligible and apply for the Skills In Demand visa (subclass 482).

Once we receive the candidate’s CVs and the position they are being hired for, we can perform an eligibility assessment within minutes.

Are there specific occupations that the sponsored workers must be assigned to?

Yes, the sponsored workers must be assigned to occupations list on the Core Skills Occupation List [Link]

What are the English language requirements for the sponsored workers?

When applying for the Skills in Demand (subclass 482) Visa, primary visa applicants are required to demonstrate that they meet certain minimum standards of English language proficiency by taking and achieving a specific result in an English language test, unless exemptions apply. Please speak to our Migration Agent for detailed information.

Are there any additional benefits of the OHLA since the new SID 482 visa launched in December 2024?

Yes. More stringent financial evidence is now required for individual businesses when nominating an applicant on a SID 482 visa. Smaller companies may find it more challenging to prove they can adequately finance the new worker. Using an OHLA, eliminates any risks.
