What is an on-hire labour agreement?

An on-hire labour agreement serves as a collaboration between on-hire labour companies, such as Pendragon, and businesses seeking skilled talent. This arrangement enables the on-hire labour company to sponsor individuals from overseas, facilitating their temporary employment in Australia before on-hiring them to other organisations. Pendragon utilises this framework to sponsor employees with specialised skills in high demand within Australia, spanning fields like IT, engineering, technology, accounting, health and more.

What are the requirements?

Under an on-hire labour agreement, people come under the Skills in Demand (Previously the Temporary Skilled Shortage (TSS)) 482 visa. All workers must meet minimum English language requirements and have the necessary skills, qualifications and experience to complete the work required. Workers brought in under an on-hire labour agreement must also be:

  • Employed full-time in Australia
  • Paid by the company that sponsors them, but they can be outsourced to another company.
  • Paid a salary that is equivalent to what an Australian would receive for the same work and cannot be less than AUD $70,000 per annum.
  • The employment contract may be structured either on a daily rate or a fixed salary, encompassing all employment entitlements, provided it adheres to the specified minimum requirements and fulfils the conditions of the visa.

What are the advantages of on-hire labour agreements?

Collaborating with a company possessing an on-hire labour agreement offers several benefits for businesses:

  • Global Talent Access: Businesses gain access to overseas talent, especially valuable when local sourcing of specific skills proves challenging.
  • Flexible Employment Periods: Workers can be engaged for up to four years, contingent upon their skills and roles, providing flexibility for both employers and employees.
  • Sponsorship: Companies may find it challenging to meet the legal requisites for directly sponsoring overseas workers. On-hire labour agreements offer a viable alternative.
